- “User,” “Client,” or “You” refers to any individual or business using our services.
- “Services” include website development, digital marketing, CRM automation, WhatsApp API, and other business solutions.
- “Platform” refers to our website and integrated tools.
- Eligibility & User Responsibilities
To use our services, you must:
Be 18 years or older and legally eligible to enter a contract.
Provide accurate business and personal information when registering.
Comply with Meta’s Developer Policies (if using WhatsApp API, ads, or integrations).
Use our services for lawful business purposes and not engage in fraudulent activities.
Failure to meet these criteria may result in suspension or termination of services.
- Services & Payment Terms
Project Scope: All services, including website development, digital marketing, and API integrations, will follow agreed-upon deliverables in the proposal.
Pricing & Payments: Fees are based on service packages. Payments must be made in advance unless otherwise agreed.
Refunds: Services are non-refundable once delivered, except under our Return & Refund Policy.
Third-Party Costs: Clients are responsible for domain registration, hosting, Meta ad spends, and API provider fees (if applicable).
- WhatsApp Marketing
Ad Compliance: Clients must ensure compliance with Meta, Google, and other advertising platform policies.
We are not responsible for ad rejections due to policy violations or content restrictions imposed by platforms.
- WhatsApp API & Meta Integrations
API Usage & Restrictions:
- Clients using WhatsApp Business API must comply with Meta’s Business Messaging Policies.
- Unauthorized automation, spamming, or misuse of user data will result in immediate termination.
Data Privacy & Compliance:
- We do not store or misuse WhatsApp chat data.
- Clients must ensure user consent before sending automated messages.
Meta reserves the right to suspend access to non-compliant businesses.
- Confidentiality & Data Protection
Client Data Protection: We handle all data securely and do not disclose sensitive information to third parties without consent.
NDA (Non-Disclosure Agreement): Clients handling proprietary business models, marketing strategies, or customer databases can request an NDA.
- Termination & Service Suspension
We reserve the right to suspend or terminate services if:
A client violates Meta’s Developer or Business Messaging Policies.
Payments are overdue beyond 7 days.
The service is misused for spamming, illegal activities, or misleading advertising.
Clients can request termination at any time. However, no refunds will be issued for services already rendered.
- Limitation of Liability
Msgtick is not liable for:
Losses caused by third-party services (Meta, hosting providers, payment gateways).
Business disruptions, revenue loss, or damages due to technical failures beyond our control.
Ad account suspensions due to Meta or Google policy violations.
Our total liability is limited to the amount paid for the services in the last 3 months.
- Modifications & Updates
We may update these Terms at any time to comply with Meta’s policies, legal regulations, or business changes. Continued use of our services after updates means acceptance of the new terms.
- Governing Law & Dispute Resolution
These Terms are governed by the laws of India. Any disputes will be resolved through arbitration in Coimbatore, Tamil Nadu.
